Terms of Service
By using the mosuki.com web site, a service of Mo-Tsuki, LLC, you are agreeing to be bound by the following terms and conditions ("Terms of Use").
Basic Terms:
- You must be at least 18 years old to use the mosuki.com site.
- You are soley responsible for any activity that occurs under your mosuki.com account.
- You are responsible for changing your temporary password to a password of your choosing.
- You are responsible for keeping your password secure.
- You must not abuse, harass, threaten or intimidate other mosuki.com users.
- You must not use the mosuki.com service for any illegal or unauthorized purpose. International users agree to comply with all applicable foreign and U.S. domestic laws regarding online conduct and acceptable content.
- You are solely responsible for your conduct and any data, text, information, screen names, events, messages, graphics, photos, profiles, audio and video clips, links, etc. ("Content") that you submit, post, and display on the mosuki.com service.
- You must not modify, adapt or hack mosuki.com or modify another website so as to falsely imply that it is associated with mosuki.com.
- You must not create or submit unwanted email to any mosuki.com members ("spam").
- You must not transmit any worms or viruses or any code of a destructive nature using any facility provided by Mosuki or the mosuki.com site.
- You must not, in the use of mosuki.com, violate any laws in your jurisdiction including, but not limited to, copyright laws.
- You acknowledge that through use of mosuki.com, you potentially reveal personal information regarding yourself and your activities to users in your network. You agree to use mosuki.com responsibly, and not to reveal such information to persons whom you do not trust with that information, for example, by sharing events with persons you do not know. You agree that any information you may reveal is your responsibility. You will not hold Mosuki liable for any consequences of your sharing of any such information.
If you violate, or if it appears to Mosuki that you have violated, any of these Terms of Use, Mosuki may terminate your mosuki.com account immediately without notice. While Mosuki prohibits the above conduct and certain Content on its site, you understand and agree that Mosuki cannot control and shall not be responsible for the Content posted on its web site or for the conduct of mosuki.com account holders. You nonetheless may therefore be exposed to such prohibited Content and conduct and you agree that you use the mosuki.com service at your own risk.
General Conditions
- Mosuki reserves the right to modify or terminate the mosuki.com service for any reason, without notice at any time.
- Mosuki reserves the right to alter these Terms of Use at any time. If the alterations constitute a material change to the Terms of Use, we will notify you via mosuki.com's internal messaging service. What constitutes a "material change" will be determined at our sole discretion, in good faith and using common sense and reasonable judgment.
- Mosuki reserves the right to refuse service to anyone for any reason at any time.
- Mosuki may, but we have no obligation to, remove Content that we determine in our sole discretion to be unlawful, offensive, threatening, libelous, defamatory, obscene or otherwise objectionable or in violation of any party's intellectual property rights or of these Terms of Use.
Copyright (What's Yours is Yours)
- Mosuki claims no intellectual property rights over the material you provide to the mosuki.com service. Your profile, events, places, messages, and photos uploaded remain yours. You can remove your events, places, and photos at any time by deleting them. You can remove your profile at any time by deleting your account. Any messages you sent will remain. By setting your events, places, messages, photos, and other objects to "public", by sharing them with other users, or by placing them in a "scene", you agree to allow other mosuki.com users to view and share these objects and you therefore agree to allow us to display and store them.
- Mosuki undertakes to obey all relevant copyright laws, however misguided we may judge them to be. We will review all claims of copyright infringement received and remove content that we believe to have been posted or distributed in violation of any such laws. To make a claim, please provide us with the following:
- A physical or electronic signature of the copyright owner or the person authorized to act on its behalf;
- A description of the copyrighted work claimed to have been infringed;
- A description of the infringing material and information reasonably sufficient to permit Mosuki to locate the material;
- Your contact information, including your physical address, telephone number, and email address;
- A statement by you that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and
- A statement that the information in the notification is accurate, and, under the pains and penalties of perjury, that you are authorized to act on behalf of the copyright owner.
